Pennsylvania Chemical Test Refusal

Breath Test (Breathalyzer), Blood Test and Urine Tests

If you refused a chemical test of your blood or if the arresting officer alleges that you refused then your life just became more complicated. There is an automatic one year suspension (in addition to the DUI suspension) for a refusal of a chemical test. The consequences of a refusal may also have dire consequences at a trial on the charge of DUI if you elect to defend the charges. The District Attorney can request that the jury be advised that you refused a chemical test and that you did so because you knew that the results would show that you were intoxicated. It is therefore important to act immediately to avoid these consequences and to be prepared.
